What is a settlement agreement?

A settlement agreement is a legally binding contract between an employer and an employee that brings the employment relationship to an end on agreed terms. In return for signing, the employee waives their right to bring employment claims against the employer — typically in exchange for a financial payment. Settlement agreements are designed to ensure both parties part ways on mutually acceptable terms.

Are settlement agreements taxable​?

Settlement agreements are partially taxable, depending on the type of payment involved. The first £30,000 of an ex gratia payment is tax-free with no income tax or National Insurance to pay on that portion. Contractual payments such as notice pay, holiday pay, and unpaid wages are always fully taxable regardless of the £30,000 threshold. Employer pension contributions paid directly into your scheme as part of the settlement can also be made free of tax.

Do I need a solicitor for a settlement agreement?

Yes, you legally need a solicitor to sign a settlement agreement. UK law requires you to take independent legal advice from a qualified solicitor before the agreement becomes valid. Without it, the agreement has no legal standing and cannot be enforced. Your employer is required to contribute to the cost of that advice, and in most cases covers the fee in full.

Can a settlement agreement be withdrawn​?

A settlement agreement costs you nothing as an employee. Your employer is legally required to contribute to your legal fees as part of the settlement.
